General Terms and Conditions of Sale

All deliveries are subject to the General Terms and Conditions of Sale set out below.
Any exception must be made in writing and expressly accepted by INTRAFIN N.V..

 1. Acceptance of Terms

Each order automatically implies the customer’s acceptance of these General Terms and Conditions of Sale and the rejection of the customer’s own general terms and conditions of sale or purchase, unless otherwise expressly agreed in writing.

2. Delivery Times

Delivery times are provided for informational purposes only.
Delays cannot give rise to compensation, penalties, or termination of the contract.

INTRAFIN N.V. declines all responsibility for damages or penalties resulting from late delivery. Delivery deadlines shall be extended during periods of delay. Customers will be promptly informed of any significant delays.

3. Pre-Orders and Product Allocation

For pre-orders of popular products, including but not limited to items such as Pokémon products, demand may exceed available supply. In such cases:

• Pre-orders placed on time may still be subject to allocation
• Partial or non-delivery of pre-ordered items may occur

INTRAFIN N.V. shall not be held liable for any claims, losses, or damages (including loss of profit) resulting from non-delivery or reduced delivery quantities.
By placing a pre-order, the customer acknowledges and accepts this risk.

4. Taxes and Duties

Any taxes, duties, indemnities, or similar charges established in accordance with Belgian law shall be borne entirely by the customer.

5. Payment Terms

Invoices issued by INTRAFIN N.V. are payable upon receipt, unless otherwise explicitly agreed and stated on the invoice.

The following terms apply:

• Any delay in payment will automatically and without formal notice incur interest at a rate of 12% per year
• In the event of total or partial non-payment by the due date, the outstanding amount will be increased by 15%, with a minimum of €125, as a fixed administrative fee, even if a payment extension has been granted
• All additional costs (including collection fees, bailiff fees, lawyer fees, and administrative expenses) shall be borne by the debtor
• Any total or partial non-payment will render all outstanding sums immediately payable, including those not yet due

In the event of non-payment, INTRAFIN N.V. reserves the right to:

• Suspend all deliveries
• Consider the contract and all related deliveries automatically canceled, in whole or in part, without prior formal notice

6. Claims and Complaints

All claims must be submitted by registered mail within 8 days of delivery.
For faster assistance, customers are encouraged to notify us as soon as possible by email or phone.

Claims submitted after this period will be deemed invalid.

7. Retention of Ownership

The goods remain the property of INTRAFIN S.A. until full payment has been received.

8. Governing Law and Jurisdiction

These terms are governed by Belgian law.
Any disputes fall under the exclusive jurisdiction of the courts of the Brussels district, unless mandatory legal provisions provide otherwise.

9. Language of the Terms

These terms and conditions are binding regardless of the language in which they are provided.
In case of discrepancies or interpretation issues, the Dutch version shall prevail.

10. GDPR Compliance

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

11. Updates to the Terms

We reserve the right to amend or update these General Terms and Conditions at any time.
